Special Meeting of April 15, 2013

1. Called to Order:
-The Special meeting was called to order by acting chairman Jonathan Shaw at 7:02 pm. The purpose of this meeting was to discuss the possibility of adopting interim zoning in the Town. Jonathan Shaw asked for a moment of silence in memory of those killed and injured in todayâ€™s bombing at the Boston Marathon before discussion.
A. Note that there were approximately 90 people in attendance at the meeting. The Selectboard, townspeople in attendance, and members of the Planning Commission (PC) and the Zoning Board of Authority (ZBA) in the audience including, but not limited to, Tim Maxham, Terry Delano and George Rice asked and answered questions for about 1-1/4 hour on the following:
Commercial land development in South Hero has historically been designed to be small in scale, and to serve the needs of Town residents and nearby communities. In accordance with the 2009 Town Plan, the Town of South Hero is interested in ensuring that this development trend continues. The Town is also interested in focusing commercial growth and more dense development in a new village district as described in the Plan.
The Town of South Hero has completed a village district visioning process. The Town would like to adopt interim regulations to allow time to complete village district planning and modify the Development Regulations to bring them into conformance with the 2009 Town Plan. The interim bylaw will prevent land development which is not in conformance with the plan or substantially limits the ability of the Town to implement the goals and policies of the Plan.
A: Anne Zolotas made a motion to adopt the following interim zoning regulations per State Statute: â€œTitle 24: Municipal and County Government, Chapter 117: Municipal and Regional Planning and Development, # 4415. Interim bylawsâ€: as follows, seconded by Skip Brown. All so voted to adopt:
General Definitions are amended as follows (underline shows added language). The remainder of the Development Regulations remain in effect and unchanged:
COMMERCIAL: A commercial use shall be limited in size to a maximum of 3,000 square feet, and shall include, but not be limited to, grocery, hardware, drug, general stores, as well as car and boat sales and service, department stores, gift shops, youth or other camps, clubs, indoor recreation facilities, and any other facility for wholesale or retail sales of goods or services.
PROFESSIONAL SERVICES: Professional Services shall be limited in size to 3,000 square feet and shall include, but not be limited to financial institutions, consulting firms, real estate or insurance agencies, doctors, lawyers, architects, accountants, travel agencies, and establishments providing similar services, but not including manufacturing, repairing, processing, or fabrication of any article, substance, or commodity.
INDUSTRIAL: An industrial use shall be limited in size to 5,000 square feet and include, but not be limited to, manufacturing and associated activities.
Note: Hotels and Motels and Restaurants will not be limited in these interim bylaws.
